1. The agreement
The agreement is between the company that runs telkit and the business that opens an account. It consists of these terms, the price list on the pricing page and the privacy policy.
The person who registers the business accepts the terms on its behalf. We record when that happened.
You can reach us through the contact page.
2. Who may use telkit
- telkit is for businesses with a Norwegian organisation number. At registration we look the number up in Enhetsregisteret and take the name and address from there.
- The person who registers needs an email address and a Norwegian mobile number. Balance notices go there.
- An organisation number can belong to only one verified account.
- A business has one owner. The owner and administrators can invite others with a role. An invitation is valid for 7 days.
3. The service
telkit sends and receives SMS and email, sends letters digitally through Digipost or on paper, makes and receives calls on Norwegian numbers, records calls and turns speech into text. Everything is available through the API and the dashboard.
A business can have several profiles. Each profile has its own services, API keys, webhooks and, if the business sets one, a monthly spending limit.
4. Plans
- Start
- You pay NOK 50 plus VAT once by card, and NOK 50 is added to your balance. The plan can be bought once per company. On this plan you cannot top up again until you move to Bedrift.
- Bedrift (business)
- The base fee is NOK 199 per month or NOK 1,990 per year, excl. VAT. It is drawn from the balance in advance for each period. The first draw happens after the first top-up. You can top up whenever you like.
- Tilpasset (custom)
- A price list of the business's own, agreed with us. Contact us to agree on one.
5. Balance and payment
- telkit uses a prepaid balance in Norwegian kroner, excl. VAT. Everything that costs money is drawn from the balance.
- The balance never goes below zero. If it is too low, the action is refused.
- When an action starts, we hold its price on the balance. When it finishes, the actual amount is drawn and the rest is released.
- You top up by card. The card is charged the amount plus 25% VAT, and the balance receives the amount excl. VAT. The smallest top-up is NOK 500 and the largest NOK 100,000, excl. VAT.
- With automatic top-up you choose a threshold and an amount. When the balance falls below the threshold, we charge the saved card. After 3 failed attempts in a row, automatic top-up switches itself off.
- A card is saved only when a user has agreed that telkit may charge it later.
- The owner gets a notice by email and SMS when the balance falls below NOK 500 and below NOK 100.
- The balance does not expire.
6. Prices
Prices are on the pricing page. If the business has a custom price list, that list applies. The dashboard shows what each action cost.
7. Approvals and verification
- We approve SMS sender names, email senders, letterheads, dedicated SMS numbers and phone numbers before they can be used. Until a sender name is approved, SMS are sent from a number recipients can reply to.
- Before a business can send letters, make calls or get its own SMS number, it must be verified. For that we need a certificate of registration (firmaattest) less than three months old, who can sign for the business, its beneficial owners, what the services will be used for, and acceptance of the rules of use and the emergency number statement.
- We may decline an application. If we do, we tell you why.
8. Rules of use
The business is responsible for the content it sends and for having the right to contact its recipients. Among other things, this means:
- Marketing by SMS, email or automated calls requires the recipient's prior consent (section 15 of the Marketing Control Act). Telemarketing to consumers registered in Reservasjonsregisteret is forbidden (section 12).
- Spam, fraud and content that is unlawful in Norway are not allowed.
- Sender names, sender addresses and letterheads must be the business's own or ones it has the right to use. They must not suggest that someone else is sending.
- If the business records calls, the participants must know. Secretly recording a conversation between others is a criminal offence (section 205 of the Penal Code).
- When a recipient replies to an SMS with one of the words STOPP, STOP, AVMELD, the profile sends no more SMS to that number until the recipient replies START.
- Calls go out from an active number the business has obtained through telkit, and only to Norwegian numbers.
9. Suspension
We may stop the business's paid actions and outbound traffic when:
- the base fee cannot be drawn from the balance, until it is paid
- a card payment is reversed
- the use breaches these terms or the law
During a suspension we still receive what comes in to the business and hold it until the suspension ends.
10. API keys and access
The business is responsible for its API keys and for who is a member. What is done with a key is drawn from the business's balance. A key that may have leaked must be revoked in the dashboard at once.
11. Personal data
For the content the business sends and receives through telkit, the business is the controller and telkit the processor under Article 28 of the GDPR. As processor, telkit will:
- process the data only on the business's instructions, meaning the calls it makes and the settings it chooses
- make sure that everyone with access is bound by confidentiality
- secure the data as Article 32 requires
- use the suppliers listed on the subprocessors page, and tell the business before adding a new one, so it can object
- help the business answer requests from data subjects
- notify the business without undue delay of a security breach
What we process, where and for how long is described in the privacy policy.
12. Closing the account
The owner can close the business's account in the dashboard. This then happens:
- Paid actions stop, and automatic top-up and recurring fees end.
- Unused balance is refunded to the card payments it came from, never more than each payment was.
- If money is left that no card payment can take back, we arrange the refund by hand.
13. Changes to these terms
The date at the top shows when these terms last changed.
